Ebay france get fined 1.7 million euros

Ebay have been fined 1.7 million euros for violating an injunction that stops users from buying or selling cosmetics and perfume products from maker LVMH.

In June 2008 a court ruling forbid users in France from dealing with specific LVMH products which include perfumes from famous makes such as Givenchy and Christian Dior. LVMH had accused ebay of allowing the sale of counterfeit products however the ban even applies to genuine goods as well, even if they are brand new and unused.

Ebay general manager in France, Alex Von Schirmeister said to the press “The injunction is an abuse of ‘selective distribution, It effectively enforces restrictive distribution contracts, which is anti-competitive.”

He also stated that the fine was too high when compared with other rulings in the past and ebay have appealed hoping that a higher court will overrule the fine.
