Legal Action Over Fallout Continues

Bethesda and Interplay look to become embroiled in a legal battle over who owns the rights to the game after Bethesda decided to stop Interplay producing a Fallout MMO.

The Fallout fan site “duck and Cover” had reported that Bethesda had dropped an appeal against an initial judgement in favour of Inerplay, but Peter Hines – the spokesperson for Bethesda – later said to Kotaku that the legal battles was far from over.

“That is still ongoing and has not been resolved. It is a minor procedural thing that took place, not a dropping of the lawsuit… The bottom line is it’s an ongoing legal matter, it’s in no way, shape or form done,” He said.

Bethesda bought the rights to Fallout from Interplay in 2004 and licensed it back to them as part of the agreement. It was a means to stop interplay’s financial troubles.

Yet things turned sour last year when Bethesda accused Interplay of selling the older Fallout games without their permission. This then lead to an attempt to prevent the development of the MMO.

Interplay maintain they will continue making the Fallout games. They have also said that the MMO is still being developed and say that they are being exploited by Bethesda because of their precarious financial position. Interplay were quoted in Gamasutra as saying that Bethesda were “keenly aware that Interplay could not fund expensive, protracted litigation”.
