Microsoft Allowed to Argue Invalidity of Eolas Patent

___________ Bloomberg News broke the news yesterday that Microsoft will be allowed to argue that patents held by research firm Eolas Technologies regarding the ability to embed functionality in a Web browser page are invalid, when a retrial of Eolas' long-running patent suit begins on July 9. |

At one time, software was copyrightable but not patentable, being considered in the same way as calculations that were part of a process.
Maybe it would be better if the whole mess was swept away, back to that state, as it seems there are more "bad" software patents, subject to endless dispute over who WAS first to document it, and if anyone else could void it by locating "prior art", patented or not, than true protections of genuine and unique innovation.
