All bets are off, Apple and AT&T. As we previously said, AT&T's threats against anyone would not hold water if the software unlocking code was released as freeware or open source. This is because the exemption to the DMCA (.PDF) regarding software unlocking specifically says:

Computer programs in the form of firmware that enable wireless telephone handsets to connect to a wireless telephone communication network, when circumvention is accomplished for the sole purpose of lawfully connecting to a wireless telephone communication network.
