Lawsuit Filed Over "Cell Phone Use While Driving" Ban
Source: Tech-Ex
________ While many across the country support bans on texting and cell phone use while driving, an attorney, Blake Horwitz, has filed a federal class-action lawsuit against the city of Chicago, Mayor Richard Daley, and several police officers over the city's ban against cell phone use while driving. |

The guy does make a point though.
Let's say the city didn't have the signs up that said you couldn't make a turn (left or right) into a school zone, or that you have to stay within a speed limit through one. So, you turn into a school zone, or go over the speed limit, the cops pull you over, and give you a ticket because it's against the cities law. How do you fight it? Well.. you didn't know you couldn't turn there, or couldn't go faster than said speed as there was no sign, right? According to the law, ignorance doesn't make it right, and you SHOULD have known. Right or not that would be their stance, and as such, case closed, that'll be $100 please. In this case there should be signs, or at least a blatant public announcement that the cellphone ban is in play (newspaper and television ads) just as there are signs for everything else in a city warning you that a law is in effect. For the city not to have one IS a money grabber for them, and what's ironic is, they know it. |
