Californian Supremes to hear Bunner DeCSS case
THE ELECTRONIC FRONTIER FOUNDATION said that the Supreme Court in California will hear a challenge relating to the decryption of DVDs.
The case centers around Andrew Bunner, who republished DeCSS software, following its release by Norwegian teenager "DVD Jon". A lower appeal court held that an injunction against Bunner disclosing information about the decryption violated his rights under the first amendment. DVD-CCA had originally filed a lawsuit against Bunner to prevent him publishing the DeCSS encryption, and also named hundreds of others, saying that publication broke its trade secrets. This organization licenses media from the major Hollywood film studios. Bunner published the information after reading about the case on Slashdot. He is being represented by an EFF lawyer. She said: "DeCSS is obviously not a trade secret since it's available on thousands of websites, T-shirts, (neck)ties, and other media worldwide."
