P2P Filesharing Same as Borrowing Books Says Spanish Court
Spain's anti-piracy campaigners have suffered a new blow following yet another court ruling that clears a web site that offered links to protected cultural content of infringing intellectual property legislation.
Three judges closed the five-year case by arguing that file sharing was comparable to the "loan or sale of books," and therefore no offence had been committed. ______________ Source: Billboard.biz

I don't know if I agree. If you borrow a book you eventually give it back. If you sell a book that is used it's not in the same condition as new, and you loose ownership of said book. It would be more like being able to copy a book down to every single atom then give that copy away. Would that be okay?

That's true, but most downloaded films are only watched once, which is a fairly equivalent usage pattern to that of a borrowed, read and returned physical book. It's not quite the same, but it is similar, just as the commercial distribution is moving away from physical into the electronic realm, so is sharing.

I'm against most action taken by anti-piracy groups (like RIAA), because most of the time they walk all over the constitutional rights of the people they are trying to get, and while I am happy every time a court rules against their claims, this "loan or sale of books" sounds very thin to me.
They must be refering to the fact that the site offered only the links, as in "how to aquire the actual files", and not the files themselves. For example there are books about "how to build bombs" but they don't give you the actual bombs (I should think of a better comparison, but this one will do for now).

Funny thing happened to me , I downloaded Law abiding citizen movie HD a few months ago , it just hit cinemas around here this week.I dunno what the hell was they thinking. I think there should be simultaneous release for movies and games worldwide.

Yes, this would be the number one reason why normal people like you and me would consider piracy, availability. There are hundreds of TV shows in the US, UK and other countries (but most come from these two), that you don't really get in some dark corners of the world. Major movies have different realease dates, DVD/Blu-Ray availability is very strangely spread across the world.
Also consider the fact that anyone outside US has to use a proxy in order to use their multimedia content. What's that all about? (joke) Not to mention the contests. (/joke)

A few years ago Coast To Coast AM released their Streamlink service. As a long-time listener of the program, I was happy about that. But then I tried to subscribe to the service and found it was US-only (and Canada of course). So, I can't use Streamlink. I can't use their net-radio on their site for the same reason. Well, I now download the program from a warez site as it's the only way I can get it. So, f*&^ you very much, regional bullshit. |
