San Jose (CA) -- In a press release this morning, a representative for class action plaintiffs suing Apple for selling a defective product, are accusing the company of defective design of the transparent plate covering the iPod nano's color screen, but of covering up consumer complaints about the alleged defect.
The statement quotes David P. Meyer, co-lead attorney for class action members, and senior partner of a law firm based in Columbus, Ohio, as saying, "We intend to prove that in an effort to rush the iPod Nano to the market, Apple ignored obvious defects in the design and later tried to cover up negative responses received from consumers. We seek to recover money lost in purchasing this product as well as the $25 fee Apple has imposed on those who have returned their product after it became unusable."
