His HD3870 vpu recovery with COD4

I'm running Vista x86 (fresh install) and cats 8.3, first i had a Triplex hd3870 512mb , and while playing COD4 i kept getting Vpu recovery (screen froze, went black and 5 seconds later started back up for abit) , air flow and cooling was good so i rma'ed the card , and got a HIS HD3870 turbo , and with this card i am getting VPU recovery errors , so this time i used rivetuner and set the fan to run at 100% while i game , and the GPU never goes over 50° , but i still get the vpu errors .
i tried downgrading to 8.2 but still get the problem , but it seems not so often ..

Has anyone got any ideas ???

occasionally its just because of Rivatuner not being supported by the drivers i stopped using it a long time ago and started modding the Catalyst Control Panel...

no crashes.
